Monnaie Collection Royale Inc. buys and sells precious metals products. When you wish to liquidate part of your portfolio, you may sell your metals to us. When you wish to acquire precious metals, you may purchase from us.
PLEASE READ CAREFULLY. These terms govern (i) the purchase of precious metals by Monnaie Collection Royale Inc. (“Monnaie Collection Royale”, “we”, “us”) from a seller (the “Seller”), and (ii) the sale of precious metals by Monnaie Collection Royale to a buyer (the “Buyer”). By offering to sell to us, selling to us, offering to buy from us, or purchasing from us, including through our website, by email, or at the telephone number listed thereon, you represent that you have the legal capacity to accept these terms and you agree to them on your own behalf and, where applicable, on behalf of any entity you represent. If you do not agree, you must not use our services.
MARKET PRICE AND PRICE DETERMINATION
Precious metals are commodities whose prices fluctuate constantly. You acknowledge that Monnaie Collection Royale alone determines (i) the purchase price, when buying precious metals, and (ii) the sale and buyback prices, when selling precious metals. Due to market volatility, all offers to buy or sell must be submitted by telephone, by email, or through our website, in accordance with these terms.
TRADING ACTIVITY
During periods of high activity, it may be difficult to reach us. We process transactions exclusively by telephone, by email, or through our website. We do not accept instructions submitted by any other means.
CONTRACT FORMATION AND IRREVOCABILITY
Every transaction constitutes a legally binding agreement whereby the party concerned undertakes to (i) deliver the metals sold, or (ii) pay in full for the metals purchased. No cancellation is permitted prior to full delivery (sale) or full payment (purchase). Following full payment, a buyback may be requested in accordance with the buyback terms set out herein.
EMAIL CONFIRMATION
Following confirmation of a transaction, we will send you an order confirmation. Failure to receive an email does not invalidate the transaction. You are responsible for configuring your email filters to receive our communications.
SHIPPING OF PRECIOUS METALS
Sale to Monnaie Collection Royale
The client must ship the products within a maximum of two (2) business days following confirmation of the transaction, unless otherwise agreed for in-person delivery. The products must be received within a maximum of five (5) business days following the transaction date. Insurance applies only once the designated carrier has taken possession of the parcel; prior to that moment, responsibility remains entirely with the client.
In the event of a delay beyond the prescribed period, Monnaie Collection Royale reserves the right to cancel the transaction and recalculate the price at the prevailing market rate, or to apply market hedge fees of 0.75% per business day of delay as of the sixth (6th) business day. Non-compliance with shipping procedures may result in a $500 administrative fee.
Purchase from Monnaie Collection Royale
Within three (3) to five (5) business days following receipt of full payment, we will prepare the shipment subject to availability. Delays may occur due to increased demand or reduced supply; we will endeavour to communicate estimated timelines through our website or by email. The address provided must be accurate and you must be available to receive delivery.
In the event of a missed delivery, the client has two (2) business days to retrieve the parcel from the designated depot. After this period, insurance coverage becomes void. If the parcel is not retrieved, it will be returned to us at the buyer’s expense and risk.
If you redirect the delivery or waive the signature requirement, you assume all resulting risks. Any incident must be reported to us immediately and, in any event, within forty-eight (48) hours.
BUYBACK TERMS – PREREQUISITES AND PRODUCT VALIDATION
Any request for the buyback of precious metals by Monnaie Collection Royale is conditional upon the prior provision of the following information:
- the origin and type of product (coin, bar, etc.);
- the metal concerned (gold, silver, platinum, palladium, etc.);
- the declared weight;
- the purity or fineness of the metal.
This information must be provided before any evaluation is performed or any price is communicated. Monnaie Collection Royale reserves the right, at its sole discretion, to require the original purchase invoice or any other supporting documentation attesting to the origin and characteristics of the products.
The client acts as supplier and is fully responsible for the accuracy of the information provided. Any inaccuracy, omission or misrepresentation regarding the characteristics of the products may result in a revision of the price, the cancellation of the transaction, or an administrative fee of a minimum of $500, without prejudice to any other remedy.
The buyback price is established on the basis of the information provided and remains subject to correction upon physical verification of the products. Should a discrepancy be found between the declared information and the products actually received, Monnaie Collection Royale reserves the right to recalculate the price or to refuse any non-conforming products, and to apply administrative fees in accordance with the terms set out herein.
Order confirmation signature deadline. Once the order confirmation has been sent, the client has a maximum period of thirty (30) minutes to sign and return the duly completed document to Monnaie Collection Royale. After this deadline, the quoted buyback price is no longer guaranteed and Monnaie Collection Royale reserves the right, at its sole discretion, to revise it according to the prevailing market rate at the time the signed document is received, regardless of any price previously discussed. Receipt of a signature beyond this thirty (30) minute period does not constitute acceptance of the initial price and does not bind Monnaie Collection Royale to that price. The client is solely responsible for meeting this deadline.
Review of the agreement. The client must review the buyback agreement in its entirety and contact Monnaie Collection Royale without delay should any error or omission be found, or should any modification prove necessary.
Payment terms. Payment is made in Canadian dollars (CAD) once the products have been received, inspected, and all required information has been obtained. No payment is released before these three conditions have been fully met.
Cancellation or failure to ship. Should the client fail to ship the metals or cancel the buyback after signing the order confirmation, a cancellation fee of $500 will be charged, in addition to any loss resulting from market fluctuations on the products covered by the agreement, without prejudice to any other remedy.
Adjustment for internal error. Monnaie Collection Royale reserves the right to adjust the agreed price in the event of an internal human error occurring during the preparation of the offer or of the order confirmation.
Return of products. Where the products must be returned to the client, for any reason whatsoever, shipping and insurance costs shall be borne entirely by the client.
Counterfeit products. Counterfeit products received by Monnaie Collection Royale will, in accordance with applicable laws and regulations, be removed from circulation, destroyed and reported to the competent authorities, with no compensation to and no return to the client.
BUYBACK TERMS – PACKAGING, SHIPPING AND DROP-OFF OF METALS
Responsibility for the packaging and shipping of the products rests entirely with the client. Full compliance with the instructions set out in this section constitutes a condition of validity of the insurance coverage applicable to the shipment.
Packaging. The reuse of boxes is strictly prohibited and automatically voids the insurance coverage of the parcel. The client must use a new and suitable box, capable of supporting the weight and contents of the shipment, and must comply with the following requirements:
- Pack the products in an inner box and add sufficient protective material (bubble wrap, packing paper, foam or equivalent) to prevent any movement; when shaken, the box must produce no perceptible noise or shifting;
- Place the inner box inside a second, larger box and add padding material so as to eliminate any movement;
- Seal all openings of the outer box using clear adhesive tape applied to all flaps and seams, in addition to the adhesive already present;
- Firmly affix the barcoded shipping label to the front of the outer box;
- Photograph the parcel once it is ready and retain the photograph until the buyback process has been completed.
Drop-off of the parcel. The client must:
- Verify, before drop-off, that the parcel is properly packed and sealed and that the barcoded label is clearly visible on each parcel;
- Drop the parcel off at an official carrier location, with an employee present;
- Refrain at all times from leaving the parcel in a drop box;
- Request proof of drop-off from the attendant and retain it until the buyback transaction has been completed.
Shipping days. No shipment is to be dropped off on a Friday, on a weekend or on the day preceding a statutory holiday, in order to prevent the parcel from remaining idle within the carrier’s network.
BUYBACK TERMS – INSURANCE, CONFIDENTIALITY AND TRANSFER OF RISK
Transfer of risk. The products remain under the exclusive responsibility of the client until they are received and inspected at the premises of Monnaie Collection Royale.
Validity of coverage. Failure to comply with the packaging, shipping and handling instructions set out herein voids the insurance coverage of the parcel. The client then assumes full responsibility in the event of loss, theft, damage or disappearance of the shipment.
Discretion. Although insurance is provided by a third-party insurer, the client must at all times act as though the parcel were uninsured. Any mention of the insurance or of the contents of the shipment increases the risk of theft.
Confidentiality of the shipment. The contents of the shipment must never be disclosed, including to the carrier. The value of the products and any reference to valuables must under no circumstances appear on the box or on the shipping label. Should the carrier inquire about the contents of the parcel, the client is to state only that it contains “parts” or low-value items.
Shipment tracking. The client must track the status of the shipment until delivery and contact Monnaie Collection Royale immediately should any problem, delay or anomaly be noted.
CANCELLATION AND REFUND POLICY
All confirmed transactions, whether by email, by telephone or in person, are firm and final. No full or partial refunds will be granted. Upon confirmation, Monnaie Collection Royale commits to pre-ordering or paying for the products on your behalf in order to secure the transaction at the prevailing market price. Any cancellation request causes significant financial loss; the buyer must fully reimburse those losses, in addition to fixed administrative fees of $500 for investment products or $100 for numismatic products. Amounts due must be paid within twenty-four (24) business hours. Failing this, the matter is immediately transferred to a collection agency and ceases to be the responsibility of Monnaie Collection Royale.
LATE PAYMENT AND INTEREST
Any overdue amount accrues interest at 1.5% per month (18% per year), calculated monthly and prorated based on the number of days overdue, starting the day after the due date and until payment in full. In the event of a delay, fixed administrative fees of up to $100 may also apply, without prejudice to any other remedy provided for herein.
In the event of default exceeding five (5) business days, the account is automatically transferred to Dixon Commercial Investigators Inc., the mandated collection agency. The client irrevocably acknowledges that this agency may proceed, without further notice, with:
- Formal notice of default. Issuance of an official written demand requiring immediate and full payment.
- Collection communications. Multiple lawful telephone, electronic and written communications seeking full payment.
- Investigation and verification. Legally permitted investigations regarding the debtor’s financial situation, address, employment and assets.
- Credit reporting. Immediate reporting of the payment default to the applicable credit reporting agencies.
- Formal demand letter. Issuance of a legal demand letter requiring full payment within the specified timeframe.
- Legal proceedings. Commencement of legal proceedings without further notice, which may include:
- wage garnishment;
- bank account seizure;
- seizure of movable or immovable property;
- any other lawful enforcement measure.
The client agrees that all necessary information may be disclosed to Dixon Commercial Investigators Inc. All collection costs, professional fees, legal fees and enforcement expenses shall be added to the outstanding balance. Contractual interest shall continue to accrue until payment in full. No payment arrangement or negotiation is guaranteed or required. The client acknowledges that a payment default may result in significant financial and legal consequences.
CONFIDENTIALITY AND PERSONAL INFORMATION
To process your transactions, Monnaie Collection Royale may collect personal information (name, contact details, payment data, etc.) and retain audio recordings, in accordance with our Privacy Policy. You warrant the accuracy of all information provided and consent to being contacted by us by telephone, by text message or by email in order to facilitate transactions. Identification may be requested. Any failure to provide the required information will result in cancellation of the order.
PAYMENT
Sale
Payment is made in Canadian dollars (CAD) per the order confirmation. Where products are received by carrier, payment is made by bank transfer within five (5) business days following receipt of the metals, subject to their authentication and their conformity with the signed order confirmation. For in-person delivery, payment is made within five (5) business days following delivery.
Purchase
Full payment must be submitted within thirty-six (36) business hours and received within forty-eight (48) business hours. Amounts include the products, shipping, handling and applicable fees. Notify us immediately of any delay in order to preserve the agreed price; failing this, liquidation may occur. We may implement anti-fraud controls, delay, cancel or recall any shipment in the event of suspected fraud, and cooperate with the relevant authorities.
RIGHT OF INSPECTION AND REJECTION
Upon receipt of the products in the context of a sale, we may reject or liquidate the transaction in the event of a defective parcel, non-conforming contents, excessive wear or non-compliance with these terms. Parcels must be postmarked within thirty-six (36) business hours and received within ten (10) business days. Damaged parcels will be refused and returned to the sender. If a discrepancy is identified, we will contact you and may require an analysis at your expense; the associated costs may be deducted from the payment.
PACKAGING AND INTERNATIONAL SHIPMENTS
Precious metals must be shipped in accordance with the procedures provided at the time of the transaction. Any failure to comply may result in a $500 administrative fee, payable under our payment policy. Shipments to Canada require the appropriate customs documentation. For international deliveries, the client is solely responsible for all duties, taxes, applicable fees and required documentation.
RESERVATION OF RIGHTS
Monnaie Collection Royale reserves the right to refuse service; to correct any obvious error; to cancel any transaction, with return of funds or products less applicable fees; to require a bank transfer; to withhold a shipment or a payment in the event of unpaid orders; to withhold payments pending the required identification documents; to accept or refuse late payments; and to withhold payment pending verification of a valid credit card for fraud prevention purposes.
CALCULATION OF TIME LIMITS, PRICE ALERTS AND BEST PRICE GUARANTEE
Time limits are calculated in business days and are extended if the period ends on a holiday, a weekend, or a day on which the London Fix is closed. Price alerts are provided for information purposes and do not constitute investment advice. We match the all-in price of reputable competitors for orders placed by telephone; this guarantee may be suspended during periods of extreme volatility.
GOVERNING LAW AND DISPUTE RESOLUTION
These terms are governed by the laws of the Province of Quebec and applicable Canadian federal laws. The parties waive, to the extent permitted by law, trial by jury. Monnaie Collection Royale may seek injunctive relief. All claims must be brought individually within one (1) year of their accrual.
LIMITATION OF LIABILITY
The maximum liability of Monnaie Collection Royale is limited to the purchase price, when it buys, or the sale price, when it sells, as the case may be. No liability is accepted for indirect, punitive or consequential damages, or for technical failures beyond our control. Some jurisdictions may limit these exclusions; please verify the rights afforded to you locally.
INDEMNIFICATION
You agree to indemnify Monnaie Collection Royale, its affiliates and its representatives against any claim arising from (i) information provided or obtained; (ii) the use, purchase or sale of our products or services; (iii) any breach of these terms; (iv) any misrepresentation or warranty; (v) any infringement of the rights of others; and (vi) any failure to meet your obligations. Monnaie Collection Royale may assume control of the defence at your expense, and no settlement may be entered into without its consent.
FORCE MAJEURE
Any event beyond our control, including strikes, natural disasters, government restrictions, futures market suspensions and pandemics, suspends our obligations for the duration of the event.
MONNAIE COLLECTION ROYALE IS NOT RESPONSIBLE FOR FAILURES DUE TO FORCE MAJEURE.
ENTIRE AGREEMENT, LEGAL FEES AND DISCLAIMER OF WARRANTIES
These terms, together with the Privacy Policy and the order confirmation, constitute the entire agreement between the parties and supersede all prior agreements. Monnaie Collection Royale provides no investment advice; all decisions are made at your own risk. In any legal action, the prevailing party may recover its reasonable costs. No implied warranty, including of merchantability or fitness for a particular purpose, is granted beyond the express warranties permitted by law.
ASSIGNMENT, AMENDMENTS AND CLAIM DEADLINES
Monnaie Collection Royale may assign its rights and obligations without notice. You may not assign yours without our prior written consent. These terms bind the permitted successors of both parties. Any issue related to an order, including a damaged product, a delay, an error or a credit, must be reported within five (5) days of shipment. Time is of the essence. We may amend these terms at any time; continued use of our services constitutes acceptance of any amendment. Additional terms may be posted on our website and form an integral part of these terms.
SEVERABILITY AND LANGUAGE
Any provision found to be invalid shall be deemed modified to the minimum extent necessary to render it valid, without affecting the validity of the remaining provisions, which remain in full force and effect.
The parties have expressly required that these terms and all related documents be drawn up in French. An English version is provided for convenience only. In the event of any discrepancy between the two versions, the French version shall prevail.
By confirming a transaction with Monnaie Collection Royale, the client acknowledges having read, understood and accepted these terms in their entirety.
